1. ACCEPTANCE OF TERMS
Welcome to ifurn.com.au. We provide the following terms and conditions to you, in order to help you make informed decisions and to advise you of your rights and obligations in regards to the use of this website. Your adherence to our terms and conditions will ensure a pleasant and enjoyable experience for all users. The terms and conditions are outlined to protect you, other users of this website and ifurn.com.au. Your use of this website indicates your understanding and acceptance of the ifurn.com.au Terms and Conditions as set out below and your agreement to comply with these Terms and Conditions. We reserve the right to modify or withdraw, temporarily or permanently, this Website or any part thereof with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website. We reserve the right to change the Conditions from time to time, and your continued use of the Website following such change shall be deemed to be your acceptance of such change. "We/us" means ifurn.com.au; 'Website' means the website located at the URL www.ifurn.com.au; "Conditions" means these terms and conditions; 'Product' or 'Item' means a product or item displayed for sale on the Website; "Product Description" means Product specifications and is detailed on that page of the Website where certain terms and conditions as well as details in respect of the individual Product are provided; "Users" means the users, be they Buyers or Sellers registered on this Website collectively; "Personal Information" means the details provided by Users upon registration; 'Sellers' or 'Seller' are deemed as Free Members, Australian Cabinet Makers, furniture industry suppliers, furniture retailers and/or furniture agents having a current ABN and all appropriate licenses; “Buyers” means users who have registered on the Website to purchase products; "Users" means online visitors, traffic, be they Buyers or Sellers registered on this Website collectively; and “You” means a user of this website, whether a registered Buyer or Seller or a member of the general public not registered on the website, but not otherwise described as either.

3. IFURN.COM.AU COMMISSION CHARGES
Each item sold through the ifurn.com.au website will incur a maximum commission charge of 3.5% of the sale price, payable by the Seller to ifurn.com.au. This will be automatically deducted during the payment process with the balance of the purchase price credited to the seller of each individual item.

4. PAYMENT OF INVOICES TO IFURN.COM.AU
Invoice payments must be made within 7 days of receipt.

5. FREE MEMBERSHIP

Only Australian Cabinet Makers with a current ABN are eligible for FREE MEMBERSHIP status your business must be in compliance with item 8 of these terms and Conditions.

6.DIRECTORY LISTINGS AND MEMBERSHIP STATUS DETAILS

Listings such as Free Listing, Premium Listing, and Silver Trader are optional membership levels offered to new financial members wishing promote, advertise or sell on the ifurn.com.au website.

7. SELLERS OBLIGATIONS

REGISTERED SELLERS MUST AGREE TO NOT SELL OR ADVERTISE IMPORTED FURNITURE ON THE IFURN.COM.AU WEBSITE IN ANY WAY, SHAPE OR FORM.

Any Registered Seller/s found to be selling furniture items deemed as imported by ifurn.com.au (please see item 8 of these terms & conditions for definition of Australian Made items) will have their business registration immediately deactivated with all business details and any products/items for sale immediately removed from the website. Said Seller(s) will be banned from listing their business and/or products on the ifurn.com.au website again.
In consideration of a Sellers use of the Website, Sellers represent that they are of legal age to form a binding contract. Sellers also agree to:
1. Provide true, accurate, current and complete information about themselves and their business and products
2. Maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
If Sellers provide any information which is untrue, inaccurate, not current or incomplete, or if ifurn.com.au has reasonable grounds to suspect that such information fits any of those categories, ifurn.com.au has the right to refuse any and all current or future use of the Website or any functions thereof. ifurn.com.au is concerned about the safety and privacy of all website users. For this reason, persons under the age of 18 are not allowed to use the Website or provide any registration information to ifurn.com.au.
When registering as a seller with the site, we will open up a registered user account. When you register, you represent that you are providing complete and accurate information about yourself and your business and products, including accurate and up-to-date billing information. You agree to keep this information up-to-date. You are responsible for all activities under your registered user account, including all legal liability incurred from the use of your account by others. You are responsible for keeping your password confidential. You may not use this website in any way which:
(1) violates the rights of others
(2) is unlawful
(3) encourages conduct that would violate these terms
(4) gives rise to civil liability

The seller may not use this site to engage in any illegal activity. Sellers may not use this site to engage in conduct which is defamatory, libelous, threatening or harassing or which infringes on a third party's intellectual property or other proprietary rights. Any such behavior will result in the immediate suspension of your membership along with any login access you have to the ifurn.com.au website. The Seller agrees that any information provided through this site will be truthful and accurate.

7.1 USERNAME AND PASSWORD

You, as the seller and registered ifurn.com.au account holder, are responsible for all activity made by you or anyone you allow to use your ifurn.com.au account. You agree to keep confidential the passwords and username associated with your account. You agree to indemnify ifurn.com.au for losses incurred by ifurn.com.au or another party due to someone else using your account or username and password as a result of your failure to keep your account information confidential or as a result of your failure to use reasonable care while using the websites services.

7.2 CONTENT

Sellers are responsible for any materials posted or made available on the ifurn.com.au website, including images, text content, correspondence, articles, advertising, and links with other websites. Any content or images deemed as false, untrue or otherwise offensive in any way will not be authorised for inclusion on the website and the Seller or user submitting such content will have their membership temporarily suspended until a reasonable explanation is provided to ifurn.com.au management. It will be at the discretion of ifurn.com.au management whether the said membership will then be re-instated.

7.3 PRODUCT DESCRIPTIONS

Each product listed for sale on the Website must include a detailed product description which sets out additional specific conditions related to that product including, without limitation, product specifications such as size & material content, terms and conditions concerning estimated delivery times and any warranties or after-sales service. Suppliers must take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. ifurn.com.au aims to keep the website as up to date as possible, and each Seller is requested to keep the information, including product descriptions, appearing on this website at a particular time as current as possible.

7.4 PRICES

All items for sale on ifurn.com.au must have a price displayed in Australian dollars which includes GST.

7.5 WARRANTIES AND GUARANTEES

Sellers on the ifurn.com.au website are not bound by ifurn.com.au to provide a warranty on their products. Sellers who undertake good and fair trading practices are naturally rewarded with continued consumer support and will develop a good trading reputation on the ifurn.com.au website which will be attributed by good consumer feedback and a high rating. It is for each seller's own benefit to provide a quality product which is backed up by a reliable warranty.

7.6 SHIPPING AND DELIVERIES

All shipping and delivery details are the responsibility of the seller. Shipping and delivery details must be provided for each item that is for sale on the ifurn.com.au website, and displayed clearly on the specifications page relating to each product. Each seller must detail the delivery cost and method involved. The date, time and destination of each delivery is to be negotiated with the Buyer of an item along with the preferred method for final payment of any remaining purchase price. The Seller shall undertake to meet any date agreed upon for delivery. The Seller shall not be held liable for any delay in delivery, whatever the cause.

7.7 RETURNS/EXCHANGE POLICY

All sellers must have a returns/exchange policy for their products and this must be detailed at the time of a seller's registration on the website. Any returns or exchange policy which is specific to a particular product for sale on the website and which differs to the sellers normal returns/exchange policy, must be detailed in that products specific notifications page for display on the website. Any requests from a buyer or from ifurn.com.au management for further information must be available for presentation within a reasonable and set time frame of no more than 2 working days.

7.8 CANCELLATIONS

Each seller must have a cancellation policy relating to their products for sale and this must be detailed at the time of a seller's registration on the website. Any cancellation policy which is specific to a particular product for sale on the website and which differs to the sellers normal cancellation policy, must be detailed in that products specific notifications page for display on the website.

7.9 LICENCE AND ABN

All sellers must be an Australian registered business/company with a current ABN. You need to display all licenses that are appropriate to your business in accordance with the act that you practice under. Sellers must hold a current, valid license, where required by law, which is appropriate to the type of work their business conducts.

8. AUSTRALIAN MADE POLICY

For furniture items to be deemed Australian Made by the ifurn.com.au website, they must have a minimum 60% Australian labour content required in their manufacture/production. We stipulate that this does not include flat packed and disassembled furniture and cabinets which are imported into the country and then assembled in Australia.

9. FURNITURE INDUSTRY SUPPLIERS

It has been deemed acceptable that businesses who are suppliers of materials to the cabinet making industry may sell imported materials on the ifurn.com.au website. Such items may include timber, hardware, metals, glass, fabrics, stone and any other materials required in the manufacture and assembly of furniture items.

10. LINKS TO OTHER WEBSITES OR FROM OTHER WEBSITES

For your convenience, we provide links to other internet websites that ifurn.com.au does not maintain. 2. If mediation is needed ifurn.com.au management can be asked to facilitate any further negotiations between both parties in an unbiased capacity. At this stage any association that you may be a member of will also be notified and called in to settle the dispute quickly and promptly.
3. If the dispute is still not settled ifurn management will refer the matter to the office of Consumer and Business affairs in your state or Territory in order to bring a professional approach to the negotiations.
In the event that you have a dispute with one or more users of ifurn.com.au, you hereby irrevocably, release and discharge ifurn.com.au, its owners, employees, affiliates and agents from all past, present and future claims or actions, losses, liabilities and expenses of any kind whatsoever, concerning or arising out of any such complaints or disputes.

3. REGISTERED BUYER'S OBLIGATIONS

To be eligible to purchase products on this website and lawfully enter into and form contracts on this website you must:
1. Register by providing your real name, phone number, e-mail address, payment details and other requested information.
2. Be over 18 years of age.
3. Stipulate a suitable delivery address in Australia. Please note that PO box numbers, hotels and accommodation addresses are not acceptable.

5. PRICING

All prices listed in Australian Dollars include GST. All prices listed in American and Euro dollars are for your reference only and should not be considered absolute.

6. SHIPPING/DELIVERIES

All shipping and delivery details are the responsibility of the seller with details to be displayed clearly on the specifications page relating to each product that they have for sale. The buyer will select a delivery method at the time of purchase and provide a suitable delivery address. The delivery cost will be included in the final purchase price. The date and time of delivery is to be negotiated between the Buyer and Seller along with the preferred method for final payment of any remaining purchase price. The Seller shall undertake to meet any date agreed upon for delivery.

7. LOSS OR DAMAGE IN TRANSIT

If the seller agrees to delivering the goods he is responsible for any loss and/or damage to the goods whilst in transit and under his control. If the buyer collects the goods from the manufacturer then the buyer takes full responsibility for any loss and/or damages during transit.

8. WARRANTY

Sellers on the ifurn.com.au website are not bound by ifurn.com.au to provide a warranty on their products. Sellers are, however, asked to provide some form of warranty or guarantee which undertakes to repair or replace any product with a manufacturing or material defect, for a minimum period of 12 months This is provided that the defect is not as a result of normal wear and tear, or a natural characteristic of the material used. Details of warranties or guarantees are provided on the specifications page relating to each product listed for sale on the website. Buyers are advised to take note of such warranties as provided by a particular seller. Buyers are obligated to keep all delivery dockets, invoices and/or receipts in order to validate their warranty. It is up to you the buyer to make sure that the final presentation of the purchase meets your approval before accepting delivery and/or taking ownership of the product.

9. RETURN/EXCHANGE POLICY

All buyers are to take note of the returns/exchange policy which is provided by individual sellers and displayed on the notifications or specifications page relating to each product. In cases where this information is not displayed, any request for this information will be available from the manufacturer/seller for presentation to the customer/buyer within a reasonable time of 2 working days. This request may come from ifurn.com.au management or from users of this website.

10. PAYMENT

All prices are inclusive of GST and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery charges as set out and detailed by each Seller in the specifications page for each product. Payment can be made by any of the methods specified in the payment section of this website. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We retain the right to remove or edit any materials or products on this website. We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold.
